Trust Deed

This deed of public charitable trust executed in Delhi on this day of 28th September 2020 by Dr. Manohar Lal Gupta S/o Late Hazari Lal resident of 54/Panchdeep Apartment Vikas Puri New Delhi 110018. Representing the settler/ chairman of the trust “SAUMAYA FOUNDATION” which expression unless repugnant to the context or meaning thereof includes their heirs, Executers and administrators, etc., whereas settler of the trust is possessed of and otherwise will and sufficiently entitled to the sum of Rs. 2000/- (RUPEES TWO THOUSAND ONLY) here in after referred to as said property.

 

Whereas the following persons are permanent lifetime trustee in the trust for the purpose detailed in this trust deed:

Whereas the founders of the trust are desirous of creating a public charitable trust with a motive to serve the society at large, child development, woman empowerment, prevention of social evils prevalent in the society, development homes for old age and empowering all section of society through providing basic and higher education and skills to develop competencies to make them self sufficient, self reliant and economically stable to lead normal life without any motive to make any profit or have any other form of gain by doing so. This may be associated with SKILLS INDIA MISSION launched by honourable PM MR. NARENDER MODI JI.

These objectives and purposes are expressed in this trust deed under clause 3 of this deed.

 

NOW THIS DEED OF DECLARATION WITNEESETH:

. To provide Sanskrit education, the English education, computer education and training for poor and needy persons.
. To establish educational academies for teaching languages as well as professional and vocational training .
. To establish schools for children and sports academies especially in rural areas.
. To create a sense of belonging, cooperation , mutual harmony , love and affection amongst the members of the society and general public.
. To promote establishment and /or acquisition / take over /run and maintenance or support of schools, colleges, Vidyapeeths, Bal Mandirs, study centers, universities and others institutions for imparting education and training to the students.
. To initiate, establishment and maintenance of and support of hostels and/or boarding houses and grant of free boarding and lodging to poor and deserving students and also by taking the necessary charges from the students who is / are capable to pay the same.
. To generate grant of endowments at universities, research institute and other educational and scientific institution (whether now existing or here after established) for spread of the education and knowledge in all or any branches of knowledge.
. To conduct education as process of systematic institution , training and development of knowledge , skill, mind and character, through quality in contents and standard of its presentation for raising physical , material, moral , cultural, ethical, spiritual, intellectual, economic and social condition of the communities in general.
. To arrange awarding scholarships, and fellowships to the students for the purpose of undertaking prospecting and encouraging higher education and research work in any branch of engineering computer technology, electric therapy, radiology, and bacteriology, medical science and any other branch or branches of modern applied sciences in its wide and more comprehensive sense depending upon availability of funds with the “SAUMAYA FOUNDATION (CHARITABLE TRUST”).
. To act on establishing or rendering help to any institution for the alleviation of human suffering.
. To foster promoting advancements of music and other fine arts conducting a school for imparting education music and dances, holding music concerts, dance, recitals etc.
. To promote the cause of national integration and unity of India to fight against the forces of separation in India.
. To perform the programs related to effective personality development and marketing skills.
. To render services to the woman , children, and youth of the country for their actual moral and social rights.
. To create awareness through print media ,electronic media among farmers ,villagers, cottage industries owners and masses of the people at micro level about policies, programmes and development initiatives being carried/ taken on by government at centre and state level.
. To give voice to the problems, grievances and lack of development being faced by farmers, villagers, cottage and rural industries owners, so as to their quick redressal at government and administrative level.
. To promote literacy, cultural and other social activities by generating awareness programmes. Adult Education classes, Lecturers, ESSAY Competitions, Exhibitions, Symposium, Cultural Programmes, Press Conference and seminars and depending upon the availability of sufficient amount of funds with SAUMAYA FOUNDATION (CHARITABLE TRUST).
. To carry on Community development programs/activities and also construct and develop the community Halls, Club, old Age Homes, Day Care Centre Charitable Dispensaries, Orphanages, Hospital, Libraries, Reading Rooms, give the food to poor and needy persons, play grounds, yoga training centers, Handicraft, Handloom, Training Centre, Drama stage and other training and research institute for the attainment of Aims and objectives of the trust.
. To make adequate arrangements and start/run the rehabilitation centers for destitute, widows, old men & women, poor, Torture victims, handicapped, and for mentally retarded persons for their social upliftment.
. To open the institutes & hostels for the handicapped, deaf, dumb, blind, girls & women etc.
. To take –up effective, reasonable and lawful steps for the solution of the problems relating to the blind, handicapped, mentally retarded, deaf, dumb, and other disabled by providing them all required facilities.
. TO provide free legal, medical and socio-economic help/ assistance to the poor and needy persons.
. To provide legal assistance to woman in case of domestic violence and also to organize self defense training programmes for woman.
.To conduct training and research programmes for control of the pollutions related diseases, water born diseases and to maintain/ and Secure the Herbs, Forests, Environment, Species of Animals, Birds, Wild life etc.
. To provide information and education/useful knowledge and the medical advise, to general public regarding the vices in the society (like smack, Cigarette/Biri Smoking, Alcohol AIDS)-through holding awareness camps for Drugs De-addiction and also start/ organize the lectures by expert team of Doctors, Journalists and other learned persons. To impart awareness to sex worker, Eunuch, Teaching for prevention of HIV-AIDS etc.
. To open a center for diagnostic curative and research of cancer, AIDS and other deadly diseases, organize awareness and medical camps among public & Educational Institutions.
. To arrange, establish and run primary, middle and / or higher secondary schools and/ or vocational school/ institutions and to provide the general education to the students of all sections of society and also to bring the education of best standard within the reach of poor and backwards areas, specially in the different rural areas of the country.
. To establish and maintain institutions for the handicapped, blind, poor, SC & STs, Backward classes and other needy persons. Vocational training in house hold Cottage industries, Laghu Kutir Udyog, semi-skilled jobs for self-employment, and to provide food, clothing medical aid, transportation, libraries, laboratories, reading rooms, hostels, play grounds, and other required facilities to the boys/ girls and also to the members of the trust.
. To establish & manage various kinds of educational, cultural, social and welfare, vocational training centers in the field of industrial Scientific ,medical , technical, agricultural research training institutes to introduce and develop professional courses. Handicraft and Handloom centers and courses.
. To carry on any charitable activities without having any profit motive connected with rural development programs including the development of the natural and human resources, planning implementing various scheme, drinking water projects, irrigation, water management, water harvesting, soil conservation, land reforms, improved agriculture, provisions for agriculture for inputs and equipment, dairy farming, animal husbandry, fishery livestock, poultry, forest and mineral development, horticulture, household industries, rural link roads, establishment of educational institutions, vocational and technical training centers for rehabilitation of handicapped, center for adult education, libraries reading rooms, youth and cultural centers, children and women centers, auditoriums and open air theaters, dramatic clubs, indoor and outdoor sports center community welfare centers, rural housing for weaker sections, character building , sex education center for individual self development.
. To provide and help/ assistance to the physically handicapped people/children in respect of artificial limbs and to give them vocational training on different technical/non-technical/ professional/ industrial and on the other subjects/ fields which will make them independent.
. To prepare the awareness generation kits posters, banners, audio-visual cassette, puppet shows, skits, documentaries etc, regarding various social issues and for the attainment of the aims and objectives of the above trust.
. To publish Books, charts, illustrations, Journals, Magazines, periodical, News Letter/papers and other publications on the different subjects and in different languages for the promotion of above Aims and objectives of the above trust.
. To approach the concerned authority/ authorities regarding the solution of the problems of the members of the trust.
. To assist and co-operate the other Association, Societies, Trusts in their work/activities whose aims are same like this trust.
. To arrange and manage the training institutions in typing, short-hand, Computer, Fine Arts, Crafts, Music, Painting, Modeling, Dancing, Yoga, Physical Education and in other professional training subjects.
. To make best efforts and organize various kinds of programs and/ or activities relating to family planning and to diffuse, the useful Knowledge about the medicines, equipment, method used for family planning also provide the Family Counseling facilities.
. To give provide and/ or render: monetary and / or other help and assistance for the relief of persons and animals affected by natural and other calamities such as flood, fire, famine, cyclone, earth quake, storm, accident, pestilence, drought, epidemic, unbearable cost of living and the like, to give donations, subscriptions or contributions to institutions, establishments, centers or persons doing relief work on such occasion.
. To make arrangement for mobile emergency VAN/AMBULANCE for the victims of road accidents (including dead bodies ), to provide help to pregnant ladies to shift them to near by hospitals, also to provide assistance to the old people for the emergency.
. To arrange welfare and research programs for the Indian Public and also provide necessary help/ assistance.
. To open, found establish promote, set-up, run and maintain and set up of eye-donation camps and blood donation camps, eye banks, Blood Banks, dispensaries, hospitals and other forms of organization to promote eye donation and blood donation.
. To promote, advance and encourage and or aid in helping the common man from the abuse of drugs and formulate the schemes for ameliorating the drug addicts from the deadly menace of drugs.
. Grant of medical help to the poor, and grant of medical help to persons effected during famine, floods, earthquake or any calamity or war or warlike operations.
. To encourage games, sports, yoga Naturopath and alternative therapies and other games for the improvement of health amongst youth and children on the whole by providing playground, sports clubs, yoga training centers and also organize the tournament, yoga & sport competitions on block levels and district levels.
. Trust will look in to the current situation and the changes to be made in the methods of teaching in the modern scenario in consultation with U G C, top educationists and eminent members of the teaching faculty .
To look in to the problems pertaining to child labour.
To rescue, secure and save and get release of the child labour from the unauthorized and unlawful employment of children by the factories, labour contractors or children deployed or employed elsewhere and to look in to their rehabilitation, education and upbringing of such children with the help of Director  of Social welfare and department of labour and employment at a proper age.
To look in the problems relating women empowerment, self dependence, self reliance and social liberty and getting them their lawful, legitimate and justified rights, they should have freedom of speech to express their opinion pertaining to social issues, fight for their rights regarding their employment in different fields of the Armed forces, Air force and Navy, about their Ranks and time bound promotions
To help them in case of any dowry related problems, social injustice, domestic violence , crime against women and to provide them the legal assistance in these matters.
. To help the handicapped , disabled persons to get their justified rights and privileges including reservations in their jobs and getting them examined by authorized, constituted  Medical boards in different hospitals of Delhi and get them disability percentage  certificates and help them free travel facilities in Railways and public transport with or without attendant as permissible .
Saumaya Foundation will help them to get other benefits permitted to handicapped persons under the schemes available for such persons by Director of Social Welfare eg allotments of Kisoks , telephone booths etc and also help them to procure tricycles ,walkers, canes, wheel chairs, crutches, prosthetic devices, hearing aids etc .
. To create awareness among public for prevention of corruption in society.
. To propagate the message of joining Civil Defence among the masses and public at large through media, Posters, through Whatsaap groups by creating awareness among college students, NCC Cadets, NSS Volunteers send all able bodied persons both males and females. Saumaya Foundation may seek the help of Civil Defence officers and existing members of CD Corps.
. To create awareness about fire safety for which Saumaya Foundation will have the liaison with Delhi Fire Services for creating awareness about fire safety among the public. we will request fire services department to give basic  training to RWAs ,, Community Centers colleges and Schools, regarding how to control the minor fires, and how to use fire extinguisher , types of fire and fire extinguisher, rescue operations with the help of Civil Defence and Home Guards volunteers and fire service workers.
. To safeguard the of rights of Civil Defence & Home Guards volunteers and Fire Service workers/officers to get them adequate compensation in case of their injury and death while saving lives of people during epidemics/pandemics/Disasters(Natural/manmade).

We will have liaison with Department of consumer affairs , shall create awareness  among  consumers and safe guard   their rights  in case they are deceived and exploited by false propaganda or advertisement  .We will get them basic training about  how to check impurities in day today usable items and edibles of daily use including coloures in Chilli powder, turmeric powder , adultration in Dhania powder and Mustered oil etc., and also items sold under fictitious and false names with similarities with little change in spellings
We will also constitute an award by the name and in the memory of late Dr Anoop kaur Kamal  ‘Balika Pratibha Vikas Samman’ up to the middle standard girl students  (8th standard ) with outstanding performance in studies with some social activities or participating  in extra curricular activities from weaker section of the Society 
We will notify the scheme about 4 weeks in advance through Director of education  of MCD  from one region, Government Middle school. of one region and students from Nirmal Chhaya near Tihar jail Complex , we will have a screening committee and short list 3girls by merit .3 participants , best in education , social and  extra curricular activities will be selected that too amongst  poorest of poor girls. Decision of selection committee shall be binding and final.
1st child shall be given cash award of Rs three thousand( Rs three thousand only) a memento replica of Godess Saraswati and a citation .Second best candidate shall be awarded a sum of Rs two thousand ,Replica of Godess Saraswati and a citation.
Third candidate in the merit shall be given a sum of Rs one thousand only , Replica of Goddess Saraswati and a citation .It will be given every year on the Annual Day celebrations of SAUMAYA FOUNDATION.

There will be a 5 members  committee for the selection of the candidates for this Award 
Members of the Committee may be changed as decided by Board of Trustees.
Apart from this another Award will be initiated by Saumaya Foundation by the name of “Mrs Urmil Gupta Oration Best Nurse Award” in ESI Cadre  of 5  ESI Hospitals located in NCT Region of Delhi .
A circular may be issued through Medical Commissioner/ E S I Head  Quarters/ DMA to all the concerned  hospitals . Citations shall be called for and 1 name shall be finalized and short listed after seeing the outstanding  performance  ,best track record, social work , commendable services rendered to the community / society at large to the entire satisfaction of The Administrative head  .A Selection committee shall be formed by Board of Trustees for the purpose  .
The shortlisted and selected candidate shall be given a cash award of a sum of Rs 5000/- (Rs five thousand  only), a memento and a citation certificate .
Award shall be presented on Annual Day Celebrations of the SAUMAYA FOUNDATION.
Apart from this Trust may think of initiating 7 other awards to the significant persons for outstanding performances and unblemished track record in their carrier, that me include persons from
Bureaucracy
Social Work 
Education
Medical Profession
Journalism
Ayurveda (Vaidya Shiromany Award)
Civil Defence , Home Guards, and Fire Services
And (2 )
 Life Time Achievement Awards – Two persons for commendable achievements in their life time
Trust may appoint some significant persons of repute as Honorary Patrons 
and some persons may be appointed as counselors , to seek their help and guidance in day to day functioning .

Board of Trustees may appoint an advocate and a person of repute as constituted Attorney to represent the Saumaya Foundation in case of Liaison work or any problem faced by Board of Trustees to convey their ideals/projects to seek helps from Department of Government to seek grant or assistance in any field or he may represent Saumaya Foundation for any help or assistance to be sought from the concerned department to fulfill aims and objectives of Saumaya Foundation.

. Trust will invest its money and funds according to section11(5) of the income Tax Act of 1961.
. To receive financial and non-financial assistance from Govt/Non-Government organization, international bodies, Bank, Company’ and any other legal entity or individual for attainment of the aims & objective of the organization and to fulfill the needs of the people.
. To accept donations, grant, presents, gifts and other offerings in the shape of movable and immovable properties and the same shall be utilized for the promotion of Aims and objectives of the above trust.
. To make survey for collection of data for the attainment of Aims and Objectives of the trust.
. To collect notices, notifications, policies, information from the Govt. Semi-Govt. NGO and other National/International agencies and provide the same to the members of the trust and the general public.
.The aims and objectives of the trust shall be purely for’ CHARITABLE PURPOSE ‘ which includes relief to the poor, educational, social, medical relief and the advancement of any other objects of general public utility.
.To erect, construct, alter, maintain improve, develop, manage and control all or any part of the property or the building of the above trust, necessary or convenient for the purpose of the attainment of the aims and objectives of the trust.
. To purchase/acquire the land/or building in the name of the trust for the upliftment and fulfillment of the aims and objectives of the trust.
.To do such other things/acts/ activities which are necessary and which may be incidental or conducive to the attainment of any of the object of the trust.
. All the incomes, earnings, movable/ immovable properties of the trust shall be solely utilized and applied towards the promotion of its aims and objectives only as set forth in the Memorandum of the trust and no profit, thereof shall be paid or transferred directly or indirectly by way of dividends, bonus, profits or in any other manner whatsoever to the present or past members of the trust or to any person claiming through any one or more of the present or the past members. No member of the trust shall have any personal claim on any movable or immovable properties of the trust or make any profits, whatsoever, by virtue of this membership.

4. PROPERTY VESTED IN THE TRUSTEES
The Trustees hereby transfer the sum of Rs.2000 (Rupees Two Thousand Only) The corpus of the trust will remain Rupees Two Thousand Only. The said amount will contributed by founder. The founder/settlers/trustees shall hold the said fund and other properties that may be endowed or conferred for the said Trust for the use and benefit of the Trust. The Trustees shall, out of the income realized from the properties endowed and such other endowments or donations, which they may get, pay all taxes at rates, where applicable, and all expenditure connected with the trust. Where such income is insufficient to meet the expenses, the trustees may use such portion of the corpus of the Trust fund for the purpose, as may be found necessary and where the income of the Trust exceeds the expenditure of the Trust, such excess may be added to the Trust fund.
The Bank A/c. of Trust shall be operated by the Author/Settler and any of the trustees jointly duly authorized by Board.

5. BOARD OF TRUSTEES
(a) The Board of Trustees shall comprise the founding Trustees:
Dr.Manohar Lal gupta son of Late Hazari Lal resident of 54/ Panchdeep Apartment Vikas Puri New Delhi- 110018, Chairman, Settler and Trusty.
Dr. Aman Gupta Son of Dr. Manohar Lal Gupta resident of 706A-Mahindra Apartment D Block Vikas Puri New Delhi-18, President/Trusty.
Dr. Sharvari Gupta wife of Dr. Aman Gupta resident of 706A-Mahindra Apartment D Block Vikas Puri New Delhi-18, General Secretary/Trusty.
Mrs. Urmil Gupta wife Dr. Manohar Lal Gupta resident of 54/ Panchdeep Apartment Vikas Puri New Delhi-18, Trusty
Advocate Archana Malik wife of Advocate Pankaj Malik resident of 24/92 A, Tilak Nagar, New Delhi-18, Trusty.

All the trustees shall hold office for the life time. However any trustees may resign by giving notice in writing to his/ her co trustees. Appointment of trustees, either to fill up a vacancy or as additional trustees, shall be by resolution of the founding trustees.
(b) The trustees herby declare that they for time being, behold the said sum and all gifts, contribution, subscription, donations, bequests and other money or property as and when the same shall be paid to or vested with them as the money, investment and property from time to time representing the same upon trust of object of general public utility not involving the carrying of any activity for the profit or for charitable purpose which tends to promote human welfare, providing however no part of the funds or income thereof be applied to any purpose outside India except in accordance with the approval with Central Board of Revenue, Government of India and for such purpose, as defined in objects clause(3) above.


6.POWER & DUTIES OF BOARD OF TRUSTEES

(a) To apply, the whole or part of the income or accumulation thereof or whole or part of the corpus of the trust properties for one more of the objectives of the Trust as outlined in clause (3) above or as the Trustees may from time to time determine.
(b) To convert and get in the Trust property and / or vary the investments for the time being and to invest and keep invest the Trust properties either in the purchase or mortgage of immovable properties or in shares, debentures or other securities/ investments and to alter, vary or transpose such investment from time to time as the Trustees, shall in their absolute discretion think fit. Provided , however, that accumulations of the income of the Trust properties, in respect of which notice has been given to the assessing officer under section 11 (2) (a) of the Income-Tax Act 1961,shall only be invested in accordance with section 11 (2) the Act.
(c ) To let or demise any immovable property comprised in the trust fund for such rent, on such terms and conditions as the trustees in their absolute discretion shall think fit.
(d) To open account in the name of the trust, with any Bank or Banks and to operate such accounts(s) and to give instructions to the bank and to provide for opening and operation of such account by the Author and any of the Trustees jointly duly authorized by Board. To adjust, settle, compromise, compound, and refer to arbitration all actions, suits claims, demands and proceeding regarding the trust properties.
(e) To appoint constituted attorneys or agents and to delegate to such attorney or agents all or any of the powers vested in them under these presents from time to time and remove such attorneys or agents and to appoint other or others in his or their place.
(f) To appoint or make provision for the appointment of any persons (s) (including all or any of the Trustees) as committee or administrator or managing Trustees or otherwise for the purpose of the administration of the trust, in such manner and subject to such rules and regulations as the Trustees may prescribe.
(g) To make, vary, alter or modify schemes, rules and regulations for carrying out the objects of the Trust and for the management of the affairs thereof and of running any institutions in furtherance of the objectives of the Trust and otherwise for giving effect to the objectives to the Trust.
(h) To set apart to whole or part of the income or the corpus or part thereof for any of the objectives of the Trust.
(i) The Trustees shall be chargeable only for such moneys, stocks, shares and funds, as shall actually come into their hands and shall not be answerable for neglect, default, acts of omission or commission of the other Trustees or of any banker or default, acts of omission or commission of the other Trustees or of any banker or other person with whom, the Trust properties and securities may have been deposited or handed over, unless caused by their will full neglect or Defaults.
(j) The receipt of a person authorized by the Trustees or a resolution of the Board of Trustees for any moneys paid or any property transferred or delivered to Trustees in execution of the powers of Trust.
(k) The Trustees will not be entitled to receive any remuneration as Trustees, but may reimburse themselves of all expenses actually incurred by them in connection with the Trust or their duties thereto.
(l) No Trustee shall refuse to be Chairman of the Board of Trustees, unless he/she shows his resentment to act as Chairman for a specified or unlimited duration. The Chairman shall be entitled to call the meeting of the Board of Trustees and preside over the meeting. The Board of Trustees may from time to time frame all other rules for the conduct of the administration of the Trust and regulating the meeting of Trustees, which are not covered in this deed.
(m) Resolution passed without any meeting of the Board of Trustees and evidenced in writing under the hand of two thirds of the Trustees shall be as valid and effectual as a resolution duly passed at a meeting of the Board of Trustees.
(n) Proper Books & Accounts shall be maintained by the Trust and shall be audited by an independent firm of chartered accountants.
(o) The Trustees shall maintain the minutes book, in which the proceedings of all meetings of Trustees shall be recorded by the Trustees and the Chairman of the meeting shall sign the same.
(7) CUSTODY OF DOCUMENTS
The Chairman or his/her nominee or any other Trustee, if so authorized by the Board of Trustees, shall have the custody of all the documents, deeds of title, relating to the Trust properties and investment, and the books of account and the other record relating to the Trust and shall be responsible for the preservation of the same.
(8) ADVISORY BODY AND CONSULTANT/COUNSELOR
The Trustees may maintain a set of advisors/patrons/counselor for thereof utilizing their services and guidance in furtherance of aims and objectives of the Trust.
(9) FINANCIAL YEAR
The financial year of the Trust shall start on 1st April of every year and end on 31st March next year provided that the Board of Trustees shall be at liberty to change the same from time to time if they so deem fit and Proper.


(10) ACCOUNTABILITY OF THE TRUSTEES
The Trustees, without prejudice to any other statutory or other right to indemnification that they may have, shall be jointly and severally indemnified out of the Trust Fund at all times in respect of each of every claim made against them or any of them whether in their capacity as Trustee or Trustees or personally in respect of any liability arising from or in respect of the Trust, its affair, administration or activities or any aspect of any of the same provided always that the right of a Trustee to an indemnity under this clause shall not extend to any claim arising from willful fraud or wrongdoing or wrongful omission or commission on his part.
(11) INDEMNITY OF TRUSTEES
(a) The Trustees may reimburse themselves and pay and discharge out of the Trust Fund all expenses incurred by them in or about the execution of the Trust as specifically authorized by the Trust in the meeting of the Trustees, or any of their duties under these presents including travelling expenses, but will not be entitled to receive any remuneration for the services to be rendered by them as Trustees. The expenses incurred by them in this regard will be reimbursed to them only if the same are approved in a meeting of the Board of Trustees.
(b) The Trustees shall be accountable only for such moneys, contributions and funds as shall actually come into their hands and a Trustee shall not be answerable or accountable for neglect, default, acts or omission or commission of the other Trustees, nor of any banker or other person with whom the Trust properties or any securities may have been deposited or kept for furtherance of any one or more of the objects of the Trust.
(12) UTILIZATION OF TRUST PROPERTY
If the income from the Trust property in a particular year is not fully utilized, the unspent income, subject to the applicable provisions of the Income Tax Act,1961, shall be carried over to the next year or years and spent in such subsequent year or years for achieving the objectives of the Trust.

 

(13) BENEFITS OF THE TRUST
The Benefits of the Trust activities in terms of the educational, training and related services it provides shall be
available to all Indians, irrespective of caste, creed, age, sex, or religion.
(14) ADDITIONS TO THE CORPUS
The Trust Fund may be added to, by the income from the initial fund and also by donations and other contributions from time to time.
(15) DISSOLUTION OF TRUST
The Trust may be dissolved by mutual and voluntary agreement of the Trustees. No force or coercion shall be brought about by a Trustee to bear upon the other Trustee(s) for the purpose of bringing about dissolution of the Trust. On dissolution of the Trust, all the properties and other funds of The Trust whether with the Trustees or anywhere else shall be either utilized in full for the object of the trust of shall be vested in some other Trust or any other form of public charitable organization having similar objects.
(16) IRREVOCABILITY
It is declared that the Trust is irrevocable. If the Trust fails for any reason, in the opinion of the Trustees, the net assets of the Trust, both movable and immovable shall be handed over to any Trust having the same object, as decided by the majority of the Trustees.
